The purchase of any of the products offered by The Masie implies full and unreserved acceptance of each and every one of the general conditions indicated below, without prejudice to the acceptance of any special conditions that may be applicable to the purchase of certain products.

In order to place an order, the customer must register at (https://www.themasie.com/uk/) through a data form in which he/she gathers the necessary information for the contract; data that in any case will be truthful, accurate and complete regarding his/her identity and that the user must expressly consent to by accepting The Masie's privacy policy.
By placing an order through (https://www.themasie.com/uk/), the user declares that he/she is over 18 years of age and has the legal capacity to enter into contracts.
To make any purchase at The Masie, the user will have to select the product or products he/she wishes to purchase, as well as indicate the units, colour and/or materials. Technical means to correct errors in the order

The Masie reserves the right to decide at each and any moment as to what products and / or services may be offered to a Customer. In this manner, The Masie will be able to include new products and / or services to those offered at the time. All the same, The Masie reserves the right to remove or continue with active offers at the time without previous notification of the products offered.
The purchase of the products on offer may only be fulfilled, having previously registered on The Masie website (https://www.themasie.com/uk/). The registration will be processed with a user name and a password that will identify the customer and enable him / her to access the account and allow the purchase of products offered at The Masie.
Product availability
The offers presented by The Masie are valid within the limit of available stock. The Masie reserves the right to modify the range of its products according to the constraints imposed by its suppliers.
The product purchased may undergo, due to the manufacturer's availability, non-substantial modifications in the components, characteristics or features of the batch that comprise it, provided that they do not detract from the qualities and features advertised.
In the event that any product ordered is not available or is out of stock, the customer will be informed within 24/48 hours [working days] of placing the order.
If the PRODUCT is not available and the consumer has been informed, The Masie may supply a product with similar characteristics, and the consumer may accept or reject it by exercising his right of withdrawal and termination of the contract.
In the event that The Masie does not have all or part of the order and/or the customer rejects the replacement products, a refund of the amount previously paid will be made within a maximum period of 15 days.
Observations
The colours or shades of the products offered on The Masie may vary depending on the characteristics and settings such as brightness or colour of the device with which it is viewed. The images published on our website are merely illustrative.
Warning
The user must first ensure that the items to be purchased are suitable for the intended use. The instructions for use of our PRODUCTS can be found in the product data sheets.
The user is responsible for following and respecting the indications and recommendations detailed below.:
-Follow the assembly instructions as well as correctly fixing and/or securing the product to avoid possible damage and/or serious or fatal injury. If it is a piece of furniture that needs to be fixed to the wall, to prevent it from tipping over, it must be permanently fixed with the necessary fixing devices and hardware depending on the type of wall.
-Even after installation, certain precautions must be taken.:
-Do not place heavy objects on top of a chest of drawers or other furniture not designed for this purpose.
-Place heavy objects in the bottom drawers.
-Do not let children climb or hang on drawers, doors or shelves.
-Check the stability of furniture. Do the same with the appliances you place on it. The Masie cannot be held responsible for any injury, damage or damage caused by failure to follow the above recommendations
-Recommendations for use for hammocks, sun loungers, sunbeds, and similar items: To ensure stability, we recommend tightening the screws at least once a year. Before each use, make sure that the assembly is correct, that the screws are properly tightened and that the article is in perfect condition for optimal use to avoid possible physical damage.
The order will be delivered to the address designated by the customer at the time of purchase.
The customer may cancel or modify the order, as long as the order is not being prepared for delivery. To cancel or modify the order, the customer must contact The Masie as soon as possible.
The delivery area is mainland UK, not including the Channel Islands, Jersey or Guernsey.
DELIVERY METHODS AND DELIVERY TIME FRAMES
Orders will be delivered to the person and address indicated in the order.
Orders will be delivered to the customer by DPD and/or DACHSER courier companies. The order will be considered delivered when the carrier has delivered the package to the customer and the customer signs the delivery receipt document. The customer must check the condition of the goods on receipt and indicate any anomalies on the delivery receipt form.
The maximum delivery time is 9 to 12 days (provided that all the products in the order are in stock and are not undergoing a quality check). Palletised orders (bulky orders) are delivered within 12 to 15 days.
Orders will be shipped to the customer within 7/8 days(working days) from the confirmation of the sale or order. No shipments or deliveries will be made on weekends or public holidays.
IMPORTANT
The standard door-to-door service does not include delivery to the customer's home; this is the customer's responsibility. Assembly is also not included.
PRICES AND TAXES
Prices on the Website include VAT (where applicable), but exclude delivery charges, which will be added to the total amount due as set out in our FAQ - Delivery Methods.
Prices may change at any time, but any changes will not affect orders for which we have already sent you an Order Confirmation.
The final price will be communicated to the customer in the electronic purchase process prior to acceptance by the customer.
The prices of the products listed on (https://www.themasie.com/uk/) shall be expressed in pounds.
EXPENSES
Shipping costs: The shipping costs will be borne by the end customer, in the case of individuals.
Depending on the type of return, the costs of collection shall be borne by the customer. If the cancellation of the order is communicated prior to shipment, the customer shall be exempt from any costs
The following payment methods are available:
BY CREDIT OR DEBIT CARD
You can pay immediately through our Bank's SSL secure payment gateway. If any refund or cancellation of the order is necessary, the amount will be reimbursed through the same payment card. Both personal and bank data will be protected with all the security measures established by the Organic Law of Data Protection 15/1999 and its Development Regulation with total confidentiality.
The Masie accepts payments with VISA, Verified by VISA, MasterCard and MasterCard SecureCode. The bank that issues the card must be located in either Spanish or UK territory. When placing the order, the customer will provide their card details, which will be stored directly in the 4B Gateway during the purchase process. The Masie does not store credit card information. For internal reasons of the Organisation, the payment management is carried out through Banco Santander, without this being of any consequence for the customer.
BANK TRANSFER
By cash or bank transfer in favour of PROCEED YOUR COMMERCE, SL., to the account number indicated in the order confirmation email, indicating the customer's name and order reference when making the transfer.
Orders that are not paid within 7 days of order confirmation will be automatically cancelled.
PAYPAL OR PAYPAL QUICK
The payment of the order will be authorised through PayPal, however, no money will be withdrawn until PayPal verifies that the payment is correct. To do this, it will be essential to have a PayPal account.
You can also pay through PayPal Quick, so that if the customer chooses this payment method it will not be necessary to register on our website, as The Masie will take the details specified in PayPal to process the shipment.
NOTE: We have extended the return period up to 30 days for purchases made between 18/11/2022 and 31/01/2023
According to the regulations in articles 107.2 and 108 of RD1/2007, which approves the text referred to in the General Law for the Defence of Consumers and Users of 16 November, the user will have the right to WITHDRAW from the contract for a maximum period of 14 calendar days.
In order to process the withdrawal, the products must be in the same condition as when they were delivered. To process a return, the customer must keep the instructions, documentation, accessories (nuts, bolts and keys) and the original packaging. Also, the customer will be required to send The Masie photographs of the moments before and after unpacking. Keeping the original packaging and sending photos will be essential requirements to be able to process any cancellation.
PRODUCTS
The customer will have a maximum period of 14 natural days from the day of receipt of the products ordered to inform The Masie of their wish to withdraw from the contract.
Withdrawal implies that The Masie will proceed to refund the amount already paid by the customer within a maximum period of 14 natural days, following the same procedure chosen by the customer for payment. During this period, the customer shall inform the company of his decision to withdraw from the contract by filling in the form at the end of this document and sending it to The Masie's e-mail address.
In order to return a product, it is essential that it is in perfect condition and in its original packaging, with all its accessories, and without having been used and/or manipulated.
Once we receive your request we will contact the customer to indicate the details of the return. The customer shall bear the cost of returning the products.
No product manipulated by the customer in case of misuse, breakage, etc. will be exchanged or credited; on the contrary, all guarantee will be lost. In the event of a defective product, the customer must contact us within a maximum period of 14 days from receipt of the order, so that the shipping costs will be borne by The Masie. In all other cases, shipping costs will be borne by the customer.
The products purchased on the website (https://www.themasie.com/uk/) have a 3 years for products purchased from the 1st of January 2022 (2 years for those acquired prior to that date) guarantee from the moment they are received. The guarantee provided covers any manufacturing fault or any damage occurred to the product during this period, not covering misusage, failure nor damage caused by unjustifiable repair or modification. The guarantee begins according to the date of purchase that appears in the correspondent invoice.
The product to be repaired or changed must always be the product received by The Masie with its correspondent delivery note and / or invoice. In the case of a product to be repaired, the customer may organise for the repair of the product, processing its collection and having it sent back to The Masie for its repair or the customer may equally, request the correspondent instructions or authorisation for its return and (RMA).
When referring to long life products, the consumer will be entitled to receive the correct and correspondent technical service and the supply of replacements
How to make a return to technical support
Returns to technical support must be perfectly packaged and protected, without stickers or labels on the original packaging and protections. If the product arrives at The Masie facilities with damage attributable to poor packaging or protection, the repair may not be covered by the warranty. If the original packaging is not available, the customer must use a sturdy box of sufficient size to allow the equipment to be inserted loosely; it is recommended that the customer insert sufficient protective material (bubble wrap or paper or foam bags, etc.) under, on and around the product to prevent any movement of the product inside the packaging. The customer must indicate on the shipping label the RMA number provided by The Masie.

Exclusions
The warranty is excluded in the following cases: deficiencies caused by improper use or handling, incorrect installation, incorrect storage or defects resulting from any external cause. Also, when it is damaged or damaged caused by chemical or corrosive substances.
Returns due to an external cause, such as the intervention of an unauthorised third party on the product, will not be accepted.

The consumer and user has the right to have the product repaired, replaced, the price reduced or the contract terminated, in accordance with the provisions of Chapter II, Title IV, Book II of the General Law for the Defence of Consumers and Users.
If the product does not conform to the purchase, the consumer may choose between repair or replacement of the product, both free of charge for the consumer. Repairs and/or replacements shall be carried out within a reasonable period of time depending on the nature of the products and the purpose for which they were intended
Instagram allows you to upload photos of THE MASIE products as they are arranged at home or in various spaces. All photos posted on social networks with the hashtags "#themasie" and "#mythemasie" or tagged with @themasie.design can be selected and used by The Masie in accordance with these Terms and Conditions. Below is how you can upload photos to Instagram.
Upload the photo directly to the Instagram page and tag @themasie.design and #themasie or #mythemasie to report the post. The profile must be set to public for the photo to be properly displayed.
If the photo is chosen by THE MASIE, the post will receive a comment from THE MASIE's account @themasie.design, asking for permission to publish the photo. How will THE MASIE use your photo and other information provided?
You will retain legal ownership of any rights you own (including copyright) in any photo you upload. However, by responding #YESTheMasie you grant THE MASIE a non-exclusive, perpetual, irrevocable, worldwide, royalty-free, assignable and sub-licensable licence to use the photo in the manner set forth below..
1) THE MASIE websites
We at THE MASIE may use your photo on our websites https://www.themasie.com/uk/ , including the Instagram page @themasie.design, and Facebook themasie.design, product pages and in editorial and advertising content.
In addition, by responding #YESTheMasie you also grant THE MASIE the right to use your username, real name, image, likeness, caption or other identifying information in connection with the use of your photo.
THE MASIE will choose and publish the uploaded photos at its absolute discretion. For the avoidance of doubt, THE MASIE is under no obligation to use any of the uploaded photos.
2) Campaigns and use of your own channels
If your image is really special, we may want to use it in an advertising campaign. This could include the use of the photo in any of the following formats:
Out of Home (OOH), Public Relations, Press, Direct Mail, Catalogue, Online, Online Advertising, Social and Showrooms.
If we are interested in using your photo for a campaign, we will contact you again to ask for your permission and provide you with our terms of use.
General terms and conditions of use
By responding #YESTheMasie, you warrant and represent that (i) you own all rights (including copyright) in the uploaded photo or, if the photo is subject to third party rights, you have all necessary licences, rights, consents and/or permissions to post the photo and grant the licence described above to THE MASIE, and (ii) you are 18 years of age or older.
To the extent permitted by law, you also agree to waive any moral rights you may possess in connection with any uploaded photo.
THE MASIE may use, edit, alter, reproduce, translate, publish or create derivative works from any tagged photo.
Guidelines on the content of the photos
All uploaded photos must be approved by THE MASIE. We will not select any photo that contains any of the following content:
What if I have a complaint about a photo or want it removed?
If you believe a photo hosted on our websites is inappropriate, offensive or violates someone's legal rights (e.g. trademark or copyright infringement), you can report the photo by sending an email to [email protected].
We reserve the right to remove photos from Instagram, the website or marketing materials at any time and for any reason.
